Policy
These Service & Add-On Specific Terms ("Service Terms") supplement the Hypermonkey Solutions LLP Master Terms and Conditions. These terms apply explicitly to all self-serve configurations, one-time service builds, recurring subscriptions, and individual add-ons purchased directly via the website checkout interface on https://hypermonkey.tech. By clicking "Continue Checkout," completing a transaction via Razorpay, or provisioning a build, the Client unconditionally agrees to these terms.
01The "No-Scoping" Self-Serve Model Acknowledgement
1.1. Fixed Scope Constraints: The Client acknowledges that by choosing the self-serve check-and-build model, they are completely bypassing traditional manual discovery and scoping cycles. The scope of work is strictly limited to the textual definitions of the service tiers and selected add-ons at the time of checkout. 1.2. Out of Scope Requests: Any feature request, modification, or functional capability not specifically explicitly enumerated in the checkout line items will be rejected or billed under a separate, custom Enterprise proposal. 1.3. Accuracy of Selections: The Client is solely responsible for ensuring that their technical configurations (e.g., choosing a specific stack, selection of nodes, or duration of optimization packs) accurately match their actual business requirements. 1.4. Ambiguity and Scope Conflicts: In the event of any dispute, conflict, or ambiguity regarding the interpretation of what features, functionalities, limitations, or deliverables are included within a specific service tier or purchased add-on, the technical assessment and final decision of Hypermonkey Solutions LLP shall be considered absolute, binding, and final.
02Web Engine Add-Ons & Website Architecture
2.1. Business Website Definition: The standard "Business Website" tier covers a maximum configuration of up to six (6) unique static or dynamic pages. Additional pages must be purchased separately. 2.2. Design Approval Mechanisms: • "Yes, send banana first" 🍌 Option: Hypermonkey will deliver a high-fidelity UI design mockup prior to commencing structural front-end or back-end development. The Client has exactly forty-eight (48) business hours to submit design revisions or grant approval. Failure to respond within this window defaults to an automatic design approval, and Hypermonkey will proceed to build. • "Nah, trust the monkeys" 🐒 Option: By selecting this option, the Client entirely waives their right to design previews, revisions, or aesthetic modifications. Hypermonkey reserves complete creative control over UI/UX implementation based on technical best practices. Redesigns requested post-build under this selection are subject to standard full billing rates. 2.3. Web & Cloud Hosting Subscriptions: Managed Hosting (billed at the current dynamic rate, e.g., ₹7,500/yr or as configured) is an automated, recurring subscription. • Scope of Managed Hosting: Includes basic server uptime maintenance, security patches, and application environment stability. It does not include code revisions, content updates, or adding new features to the site. • Renewal & Discontinuation: Subscriptions automatically renew annually or monthly depending on the selected billing cycle unless canceled prior to the renewal date. If hosting is canceled, Hypermonkey will package the environment and deliver it to the Client, terminating our operational support and uptime obligations immediately. 2.4. Advanced Media & Technical Add-Ons: • 3D / WebGL Hero Section: Limited to a single custom WebGL element or 3D asset integration on the landing page, optimized for standard modern desktop and mobile browsers. Massive customization or multi-page 3D transitions require custom enterprise pricing. • Custom Animations & Illustrations: Capped at a reasonable industry standard volume per standard project build. Scope creep involving frame-by-frame animation overhauls is strictly excluded. • Blogging Dashboard & Multilingual Base Setup: Includes the core infrastructure setup. For multilingual sites, the base setup covers up to two (2) languages with structural localization hooks; the actual text translation must be provided by the Client or covered under a separate copywriting agreement.
03AI Automation Suite & Infrastructure
3.1. Pipeline & Node Limitations: The "Multi-Step Pipeline" package is hard-capped at a maximum of five (5) operational nodes or logical workflow steps. Exceeding five nodes automatically pauses execution and requires the Client to upgrade to the Enterprise Automation Suite. 3.2. Managed Infrastructure & Cloud Hosting: Managed Cloud Hosting (e.g., ₹3,599/mo) is a recurring operational fee designed to cover runtime compute, database persistence, and API routing. • Upstream Third-Party Costs Excluded: Unless explicitly stated otherwise in the line items, this hosting fee covers Hypermonkey’s infrastructure container orchestration via internal systems (e.g., Dokploy). It does not include external API consumption costs (e.g., OpenAI token usage, Anthropic API costs, vector database storage charges from external vendors). The Client must link their own payment cards or API keys to these services, or reimburse Hypermonkey for usage overages. 3.3. Specific AI Add-On Definitions: • Fine-Tuning / Model Training: Includes dataset formatting, structural preparation, and processing runs on a single base model architecture. The Client must provide clean, legally compliant, and pre-formatted training data. • RAG / Knowledge Base & Vector Database Setup: Includes connecting a structured data source to a designated vector store. Document volume parsing limits apply depending on the target system constraints. • Human-in-the-Loop Review: Includes building UI entry points or validation steps inside the pipeline where a human operator can intercept automated data before final execution.
04Growth Engine & Geo Optimization
4.1. GEO Optimization Pack: Billed as a definitive 3-month cycle or recurring optimization engagement. Hypermonkey works strictly within algorithmic engineering parameters to maximize structural and layout readability for search and AI engine indexing. We provide no direct commercial or financial guarantees regarding precise search placement or lead conversion targets. 4.2. Marketing & Social Media Automation Add-Ons: • Social Media Management: If selected as a monthly recurring service, this dictates a strict monthly allotment of graphical assets and content schedules. • Email Drip & Lead Capture Funnels: Limited to core software logic setups, validation integration, and integration with supported CRM tools. 4.3. Agency Disclaimer and Performance Metrics: Hypermonkey Solutions LLP operates strictly as a technical and growth engineering provider, not as a traditional marketing, public relations, or advertising agency. The Company expressly disclaims any responsibility, liability, or warranty regarding commercial performance metrics, including but not limited to return on ad spend (ROAS), click-through rates (CTR), cost per acquisition (CPA), total sales volume, or the overall financial success of paid advertising campaigns. All Growth Engine services and add-ons are strictly limited to technical enablement, algorithmic structuring, and infrastructure optimization, without any guarantee of specific market outcomes or user conversions.
05Recurring Subscriptions, Cancellation, & GST Compliance
5.1. Automatic Renewal: All recurring monthly or annual items (such as Priority Support, Managed Hosting, Usage Analytics, and Maintenance) will automatically renew using the securely vaulted payment token provided during the initial Razorpay checkout transaction. 5.2. Cancellation Rights: The Client may cancel recurring subscriptions at any time via their Hypermonkey client dashboard or by emailing legal@hypermonkey.tech. Cancellations halt future billings but do not trigger pro-rata refunds for active billing cycles already initiated. 5.3. Statutory Taxes & Invoicing: All instant checkouts are subject to the statutory 18% Goods and Services Tax (GST) in India, which is dynamically calculated and displayed transparently in the Order Summary. Tax Invoices containing the Client's corporate GSTIN will be generated automatically upon successful gateway verification, provided the Client enters valid company details at checkout. 5.4. Chargeback & Payment Integrity: Initiating a frivolous payment dispute or chargeback through Razorpay or banking channels will result in the immediate and permanent termination of all project development, truncation of hosted cloud environments, and the initiation of legal protocols to recover outstanding balances. 5.5. Midway Pricing Adjustments: Hypermonkey Solutions LLP reserves the unequivocal right to modify the pricing of any service, ongoing build, uncompleted project phase, or recurring subscription midway through an engagement due to unforeseen technical circumstances, scope complexities, force majeure events, or upstream third-party vendor cost increases. The Company shall provide the Client with formal written notice prior to implementing any such price changes. Should the Client object to the adjusted pricing, they retain the right to terminate the affected service, provided that all development work completed prior to the date of notice is paid in full.
06Support Tier Constraints
6.1. Standard Support: Addressed sequentially during standard operational business hours. 6.2. Priority Support (6-Hour SLA): Billed as an active recurring maintenance subscription (e.g., ₹29,990/yr or as configured). The 6-hour SLA applies strictly to critical server errors and catastrophic operational line stoppages. It covers technical diagnostic remediation but does not extend to performing new out-of-scope feature builds within a 6-hour turnaround window.
07The "Monkey Jokes" Liability Exclusion
7.1. Purely Informational & Humorous Content: For all service layers where "Monkey Jokes" are listed as an included feature item, the Client acknowledges that such inclusions are purely for cultural, branding, and entertainment value. Hypermonkey Solutions LLP disclaims all legal liability, brand damage claims, or contractual penalties regarding the quality, comedic timing, or distribution of monkey-themed humor, jokes, or easter eggs embedded inside structural comments or project assets.
