This Acceptable Use Policy (AUP) establishes the strict guidelines, rules, and prohibitions governing your access to and use of https://hypermonkey.tech, our APIs, cloud infrastructure, and any software or AI development services provided by Hypermonkey Solutions LLP (Registered Office: 503, C-Wing, Kailash Garden, Yogidhan, Gauripada, Kalyan, Thane, Maharashtra – 421301, India). This AUP is incorporated by reference into our Terms and Conditions.
01Prohibited Activities and Illegal Use
You agree not to use the Website or our Services for any unlawful, illicit, or fraudulent purpose. You are strictly prohibited from: Illegal Activity — engaging in any activity that violates local, state, national, or international laws or regulations, including those governing export control, data privacy, and intellectual property. Copyright and IP Infringement — uploading, downloading, or transmitting any content that infringes upon the patents, trademarks, copyrights, trade secrets, or proprietary rights of any third party. Unauthorized Commercial Exploitation — reselling, sublicensing, or commercially exploiting the Services, APIs, or AI outputs without a formalized, written commercial agreement with Hypermonkey Solutions LLP.
02System and Network Security
Violations of system or network security are strictly prohibited and may result in immediate termination of Services and criminal or civil liability. You must not: conduct any vulnerability scanning, penetration testing, or security audits on our Website, APIs, or infrastructure without our explicit, prior written authorization; upload, distribute, or execute viruses, trojan horses, ransomware, worms, logic bombs, or any other malicious code designed to disrupt, damage, or gain unauthorized access to computer systems; launch or participate in Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks against our infrastructure; or engage in brute-force attacks, credential stuffing, or any other attempt to bypass authentication mechanisms or access accounts belonging to other users or administrators.
03Artificial Intelligence and Data Extraction
Given the nature of our operations in AI development, the protection of our proprietary logic, datasets, and models is paramount. You are strictly prohibited from: AI Model Extraction — attempting to reverse engineer, extract weights, deduce the underlying logic, or replicate the functionality of any AI models or proprietary algorithms utilized by the Company. AI Training — using our Website, APIs, or outputs to train, fine-tune, or develop external machine learning models, large language models (LLMs), or artificial intelligence systems without explicit written consent. Scraping and Automation — utilizing automated bots, web scrapers, spiders, or crawlers to extract data, code, or content from the Website or our hosted environments. Reverse Engineering — decompiling, disassembling, or reverse engineering any provided software, compiled code, or web applications.
04API Abuse and Resource Limits
If you are granted access to any Hypermonkey Solutions LLP APIs or backend resources, you must utilize them responsibly. You must not: attempt to bypass, spoof, or circumvent established rate limits, quotas, or billing mechanisms; generate unreasonable or disproportionately large loads on our servers, infrastructure, or network transit providers that disrupt the quality of service for other legitimate clients; or use APIs in a manner that deviates from their documented and intended use cases.
05Spam, Phishing, and Communications Abuse
The Website and its associated contact mechanisms must not be abused for unsolicited communications. You are prohibited from: Spam — sending unsolicited bulk emails, promotional materials, or commercial solicitations through our contact forms, support channels, or integrated mailing systems. Legal Action: The Company reserves the right to pursue full civil remedies and report severe violations (such as data breaches, malware distribution, or unauthorized security testing) to appropriate law enforcement authorities. Cost Recovery: You shall be held financially liable for any damages, infrastructure costs, legal fees, or third-party liabilities incurred by the Company as a direct result of your violation of this Policy.
07Amendments to This Policy
We reserve the right to modify or amend this Acceptable Use Policy at any time to address emerging threats, regulatory changes, or new operational requirements. The updated Policy will be posted on this page with a revised Effective Date. Continued use of our infrastructure or Services following such updates constitutes your acceptance of the revised terms.
